WHAT IS INVOLVED IN DIVORCE?
Divorces that are agreed to by both parties are called “uncontested.” Once you have agreed that divorce is the best option for you and your spouse, you and your attorneys must work together to agree on many aspects of the divorce, including:
- Child custody. Virginia law allows for sole custody by one parent or joint custody by both parents. We help you reach an agreement that represents your children’s best interests and create a parenting plan that determines visitation times and other important compromises.
- Child support. Agreeing on the amount of child support to be provided often leads to a fairer result than leaving this decision to a judge who does not know your family or understand each parent’s true financial situation.
- Property division. Virginia has complex rules for dividing property. Unless the parties agree on how to divide their assets, a judge will make decisions for them. This can lead to results that no one wants. Our attorneys are determined to help you reach an agreement.
When both sides do not agree to dissolve their marriage, or when they cannot agree on an aspect of the divorce such as child support, the case will go to a judge who will determine whether there are grounds for issuing a divorce. He or she will also decide on the proper way to divide your property and make decisions about child custody and support based on Virginia law. Our attorneys help you pursue an optimal result in court by decisively presenting your side of the case.
Child Custody Attorneys
Determining child custody is often one of the most stressful and emotional areas of family law. It can be difficult to come to terms with the fact that you may no longer be putting your child to bed every night. An experienced attorney can help you understand how child custody law works while advocating for your and your child’s best interests.
KNOWLEDGEABLE JOINT CUSTODY LAWYERS
At Mahdavi, Bacon, Halfhill & Young, PLLC, we have more than 40 years of experience working with families throughout Northern Virginia as they develop custody agreements that are tailored specifically to their needs and goals for the future.
In Virginia, custody is both legal and physical. Legal custody refers to decisions that are made about a child’s education, medical care, religion, daycare, and more. Physical custody refers to where the child will spend his or her time. Typically, when these responsibilities are shared, it is called joint custody. When one parent has primary decision-making and caretaking responsibilities, it is called sole custody.
In most cases, our clients come to us fully aware of the best interests of their children and they are looking for a legal professional who will help them achieve these goals. We give our clients the information they need to make educated decisions about their custody agreements. In the courtroom, our goal is to present the evidence in a way that is most compelling for your case.
Child Support Attorneys
Child support was created to serve the financial interests of the child, not the parent. While it is true that child support is often determined according to a set of guidelines, a knowledgeable attorney will know how to use these guidelines in a way that best supports your child’s interests.
KNOWLEDGEABLE SUPPORT MODIFICATION LAWYERS
Planning for child support requires a thorough understanding of your budget. At Mahdavi, Bacon, Halfhill & Young, PLLC, our attorneys will take a close look at your financial situation as it compares to your child’s needs. In many cases, certain elements of these guidelines do not apply to every family.
It is important to understand that these are simply guidelines, not hard and fast calculations. If this were the case, anyone could figure out their child support without the help of a legal professional. In instances where both parents can agree, an agreement can be reached entirely outside of the child support guidelines.
We understand that our clients want what is best for their children and we will work diligently to create a child support agreement that reflects this. We will give you the information you need to make educated decisions about child custody.
